The Mod Pizza name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Mod Pizza or its affiliates. You may not use such marks without the prior written permission of Mod Pizza. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its Content solely for your personal, non-commercial use in connection with accessing our food ordering services. This license does not include the right to:

We do not warrant that:
- The Site will be available, uninterrupted, timely, secure, or error-free;
- The results that may be obtained from the use of the Site will be accurate or reliable;
- The quality of any products, services, information, or other material purchased or obtained by you through the Site will meet your expectations;
- Any errors in the Site will be corrected.

7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOD PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SERVICE PROVIDERS, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE OR SERVICES EXCEED THE GREATER OF: (A) ONE HUNDRED DOLLARS ($100.00 USD), OR (B) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM GIVING RISE TO THE LIABILITY.
The limitations of liability set forth in this section shall apply regardless of the form of the action, whether based in contract, tort (including negligence), strict liability, or any other legal or equitable theory, and regardless of whether Mod Pizza has been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain types of damages, so the above limitations may not apply to you in full. In such cases, our liability shall be limited to the maximum extent permitted by applicable law.
8. Indemnification
You agree to defend, indemnify, and hold harmless Mod Pizza, its officers, directors, employees, agents, licensors, service providers, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms of Service;
- Your use or misuse of the Site or our services;
- Your violation of any applicable federal, state, or local law, regulation, or ordinance;
- Your infringement or misappropriation of any third party's intellectual property or other proprietary rights;

In addition to federal law, these Terms are subject to applicable consumer protection laws and regulations, including but not limited to:
- The Federal Trade Commission Act (15 U.S.C. § 41 et seq.), which prohibits unfair or deceptive acts or practices in commerce;
- The Electronic Communications Privacy Act (18 U.S.C. §§ 2510–2523);
- The Computer Fraud and Abuse Act (18 U.S.C. § 1030);
- The California Consumer Privacy Act (CCPA) / California Privacy Rights Act (CPRA), to the extent applicable to California residents;
- All other applicable federal and state consumer protection statutes and regulations.
Subject to the arbitration provisions below, any legal action or proceeding relating to these Terms or your access to or use of the Site shall be instituted exclusively in the federal or state courts of competent jurisdiction in the United States. You and Mod Pizza each consent to the personal jurisdiction of such courts and waive any objection to the laying of venue of such proceedings in such courts.
10. Dispute Resolution and Arbitration
10.1 Informal Resolution
Before initiating any formal legal proceeding, you agree to first attempt to resolve any dispute, claim, or controversy with us informally. To do so, please contact us at [email protected] describing the nature of your dispute and the relief you are seeking. We will attempt in good faith to resolve the dispute within thirty (30) days of receiving your notice. If we are unable to resolve the dispute informally within that period, either party may proceed to formal dispute resolution as set forth below.
10.2 Binding Arbitration
EXCEPT AS OTHERWISE PROVIDED HEREIN, ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, OR THE BREACH, TERMINATION, OR VALIDITY THEREOF, SHALL BE RESOLVED EXCLUSIVELY BY FINAL AND BINDING ARBITRATION, RATHER THAN IN COURT, IN ACCORDANCE WITH THE COMMERCIAL ARBITRATION RULES OF THE AMERICAN ARBITRATION ASSOCIATION (AAA) THEN IN EFFECT, WHICH RULES ARE INCORPORATED HEREIN BY REFERENCE.
The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. The arbitrator shall have the authority to grant any remedy or relief that would be available in a court of law.
10.3 Class Action Waiver
YOU AND MOD PIZZA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING. UNLESS BOTH YOU AND MOD PIZZA AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS OR REPRESENTATIVE PROCEEDING.
10.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights or confidential information.
11. Third-Party Links and Services
Our Site may contain links to third-party websites, applications, or services that are not owned or controlled by Mod Pizza. We have no control over, and assume no responsibility for, the content, privacy policies, terms of service, or practices of any third-party websites or services. In such circumstances, our obligations shall be suspended for the duration of the force majeure event.
